PREVIEW DATES & TIMES: The preview dates and times for inspection of the items in this auction are May 7, 2020 and May 8, 2020, from 1:00 p.m. to 4:00 p.m. each day , and on other dates and times by appointment as may be arranged with auctioneer Richard Moffat, whose telephone number is 573-690-2823. Location for preview is at the Moffat Auction Center, 467 County Road 604, Linn MO.

THIS IS AN ON-LINE INTERNET ONLY AUCTION. ALL BIDDING ACTIVITY WILL TAKE PLACE ONLINE. ALL BIDDERS MUST REGISTER TO BID THROUGH THE ONLINE PLATFORM.

PAYMENT: Payments must be made in USD (US Dollars). Please pay your invoice as soon as you receive it, unless you will be paying in person when you pick up your item(s) on May 22, 2020 or May 23, 2020. Immediately after you receive your invoice, please email moffatauct@socket.net if you desire to pay at the time of pickup.

STAGGERING AND SOFT CLOSE: This auction will start to close at 2:00 p.m. CST on May 21, 2020. Once the first item starts closing, each item will then close 20 seconds thereafter. If there is a bid on any item within the last two minutes of the auction, then the bidding on that item will automatically be extended an additional two minutes.

AGE REQUIREMENTS: A person must be 18 years or older to bid.

DESCRIPTIONS: All descriptions for each item in this auction are believed to be accurate, but the description is not warranted or guaranteed. Bidder inspection is encouraged.

DISCLOSURE: All items in this auction SELL AS-IS, WHERE IS, with all faults. There are no guarantees or warranties as to any items in this auction. If you are uncertain of the condition or use of an item, please bid accordingly.

PICTURES OF ITEMS: The description of each item controls over any picture provided for an item. For some pictures, there may be other items in the background contained in the picture because of space limitations, but only the item in the description is being auctioned.

INSPECTIONS OF ITEMS: All bidders should feel free to inspect all items. We encourage all bidders to preview the items and check condition of the items before bidding. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.

AUCTION COMPANY RESERVATION OF RIGHTS: Richard Moffat Inc. d/b/a Richard Moffat Auction Service hereby reserves the right to reject any bid for this auction at the auction company’s sole discretion. Any fraud suspected or detected will preclude a bidder from bidding at this auction and/or from being the successful bidder at this auction for any item.

BUYER’S PREMIUM: The buyer’s premium is 14% on each item. Please see language below about discount given for cash, wire transfer or approved check. Thus, if your final bid is $100, you owe $114.00, and your credit card will be charged $114.00.

DISCOUNT FOR CASH , WIRE TRANSFER OR APPROVED CHECK: There is a 4% discount given for payment by cash, wire transfer or approved check if balance owed is paid by May 23, 2020 at 4:00 p.m. CST. If you are paying by cash, check or wire transfer, please email Richard Moffat Auction Service at moffatauct@socket.net at the conclusion of the auction. There is a $10 bank fee for wire transfer that will be added to your balance. Unless the bidder is known to Richard Moffat Inc. d/b/a Richard Moffat Auction Service, all checks must be pre-approved by Richard Moffat Auction Service before the auction closes and your bank will be contacted for such approval to verify funds. Richard Moffat Auction Service reserves the right to process all checks presented as ACH transactions.

CREDIT CARDS ACCEPTED: We accept Visa, Mastercard and Discover. We reserve the right to deny any buyer’s ability to pay with a credit card if we suspect any fraudulent activity. All credit cards will go through a verification process as a part of the registration process to bid.

TAXES: No taxes on these items in this auction will be charged.

SHIPPING: We can provide assistance with shipping small items (nothing too large or heavy) at buyer’s expense for the shipping and handling. Shipping and handling expense must be paid by the buyer before the shipping occurs. Please contact us by email after the auction if you would like to have your item shipped. We make no warranty as to the condition of the item once shipping occurs, and would encourage any buyer to purchase insurance for the item(s) being shipped.

PICKUP: All items MUST BE picked up at The Moffat Auction Center at 467 County Road 604, Linn, Missouri on Friday, May 22, 2020 or Saturday, May 23, 2020, between the hours of 11:00 a.m. to 4:00 p.m. each day CST. If a buyer buys a large quantity of items and is sending a shipper or truck at buyer’s expense or direction and another shipping time needs to be arranged, please contact Richard Moffat at 573-690-2823 immediately after the close of the auction. Any items not removed within one week after the close of the auction shall be charged a storage fee unless a prior reasonable arrangement is approved by Richard Moffat Auction Service. Assistance with loading is available.

PAYMENT TERMS: All items, including the applicable buyer’s premium charge, that have not been paid by a successful bidder at the online auction as of 4:00 p.m. CST on Saturday, May 23, 2020, shall either be charged to the successful bidder’s credit card on file or MAY be offered to the back-up bidder(s) or other third party, all at the election of Richard Moffat Inc. d/b/a Richard Moffat Auction Service.

NOTICE: In the event a winning online bidder does not pay for their item(s) by Saturday, May 23, 2020 by 4:00 p.m. CST, make arrangements for an alternate pick up time that is agreed upon by Richard Moffat Auction Service, and/or make arrangements for payment and shipping that are agreed upon by Richard Moffat Auction Service by the end of the last scheduled pick up day (which is Saturday, May 23, 2020 by 4:00 p.m. CST), Richard Moffat Inc. d/b/a Richard Moffat Auction Service reserves the right to refuse to sell the item(s) to the winning online bidder and instead to sell the item(s) to a back up bidder or other third party if the auction company so chooses.

FORUM FOR DISPUTES: Any disputes as to the auction, the condition of the items in the auction, the description of the items being offered for sale, the sale of any items to a third party that was not the winning bidder at the online auction, and/or any disputes in any way related to this online auction shall be governed by Missouri law, and the forum for such disputes shall be the Osage County Circuit Court and/or the Osage County Associate Circuit Court in Linn, Missouri. By participating in this auction, any bidder and/or prospective buyer is agreeing to this forum and venue of Osage County, Missouri. Arbitration shall not be used to address any disputes that are in any way related to this online auction.

The auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item and or auction event or to make changes to the auction closing times or inspection or removal times.

INTERNET, SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, computers, software or any other online auction-related issues and/or technical issues and/or system failures , Richard Moffat, Inc. d/b/a Richard Moffat Auction Service reserves the right to extend the bidding, continue the bidding, reopen the bidding and/or close the bidding.
